Statement Concerning Initiation of Investigation by the Japan Fair Trade Commission on BHP Billiton’s Proposed Acquisition of Rio Tinto

On Wednesday, September 3, 2008, the Japan Fair Trade Commission (JFTC) announced that it had launched a formal investigation on the proposed acquisition of Rio Tinto by BHP Billiton.

The Japan Iron and Steel Federation (JISF), which asked the JFTC on March 13, 2008 to conduct an examination and to take appropriate actions in relation to the proposed acquisition, welcomes the investigation by the JFTC. JISF is confident that it will conduct a thorough examination.

JISF has consistently opposed the proposed acquisition ever since BHP Billiton announced its intention to acquire Rio Tinto in November 2007. JISF has cooperated fully with major relevant antitrust authorities, including submission of relevant documents, and intends to continue to cooperate fully with the JFTC’s investigation.

Japan’s five integrated steel mills, all members of JISF, have already filed a submission with the JFTC requesting that it take strict and appropriate actions under the Antimonopoly Act.
